Insurance Issue of the week-1 (Burglary)

Most of us observed whenever there is  burglary/theft  claim under Burglary Insurance Policy or theft of the vehicle,  the Insurer insists to file a FIR and copy of the same to be submitted to Insurer/Surveyor. If you go through the terms and condition of the respective policy which states the following wordings:

Burglary Policy
1 New India Notice to Police
2 IFFCO Tokio Lodge a complaint to police
3 Reliance Insurance Inform the police and get the FIR
4 Oriental Insurance Intimation to Police
5 United India Intimation to Police
6 Universal Sompo Lodge a complaint to police
7 Future Generail Lodge a complaint to police
8 National Insurance Lodge a complaint to police
Vehicle Insurance
As per Indian Motor Tariff in case of theft or criminal act the intimation to the police be given as per condition no.1 of the Policy

 

As per above terms and condition the insurer should not insist for the FIR and should be done away with written complaint to Police/DDR. But the insured is being harassed for filing a FIR which is contrary to the terms and conditions of the policy issued by the Insurer. Moreover, filing a FIR is a toughest job for an insured.  M/s Reliance General Insurance Company has specified that in case of burglary claim FIR is to be filed

If we raise the issue before IRDA, the Burglary policy, being non tariff, the respective insurer may revised the terms and condition of the product subject to approval of the IRDA. But Vehicle insurance is tariff business, only IRDA is empowered to modify the terms and conditions.

All are requested to review the same and give your suggestions on the wordings “ Lodge a complaint to police“ or  “Notice to Police”  or “Intimation to police”, whether it amount to filing a FIR. If most of the brokers fraternity agrees to the above conclusion or otherwise so, the further course of action may be taken i.e. to bring to the kind notice of IRDA/GIC.
