(Burglary)<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>In one of the our issues we mentioned <strong>\u201c Only intimation to the policy\u201d<\/strong> is required\u00a0 as per terms and conditions of the Burglary Policy as well as theft of Vehicle.<\/p>\n<p>In response to this we received various queries that the Insurer as well as Surveyor insist to File a Fire therefore, kindly suggest\u00a0\u00a0 \u201c Under which section of IPC the FIR should be\u00a0 filed and what should be contents of the FIR\u201d . The same is explained as under:<\/p>\n<p>The BHB policy is intended to cover contents of a premises by Burglary and\/ or Housebreaking.<\/p>\n<p>It also covers damage to the premises caused by the burglars. It doesn\u2019t cover the RSMD (available on payment of extra premium).\u00a0<strong>\u201cTheft\u201d <\/strong>\u00a0risk too , is not covered and is provided cautiously by the Insurance Company.<\/p>\n<p>Theft literally means taking away someone\u2019s property without his or her consent.<\/p>\n<p>Though the\u00a0 term Burglary is not defined under IPC but Burglary &amp; House Breaking is defined in the policy <strong><em>\u201cas theft , involving entry to or exit from the insured premises by forcible &amp; violent means. Any act committed by Insured\u2019s employee\/family member or by any person lawfully present in the premises, is also not covered.\u201d<\/em><\/strong><\/p>\n<p>The dictionary meaning of Burglary is \u201c Entry into a building , to commit Theft or cause bodily harm\u201d.<\/p>\n<p>Police may file a FIR in one of the sections namely 445, 378, 380, 381 and 457 of IPC according to their knowledge but <em>\u201ct<strong>he Insured should ensure that the contents of FIR should include <\/strong>\u201cthe <strong>forcible entry or exit\u201d in the premises\u201d <\/strong><\/em>otherwise the Insurer is inclined to repudiate the claim as the FIR does not meet the definition of the Burglary in the Policy.[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text]Contents of FIR in case of Burglary Policy?
